1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of www.junubia.net, related customer portals, and any Junubia Android or iOS app. By creating an account, submitting an order, installing an app, or using any Junubia service, you agree to be bound by these Terms and any applicable service-specific documents incorporated by reference.

2. Eligibility and authority

You represent that you are at least the age of majority in your jurisdiction and, if acting for a company or organization, that you have authority to bind that entity.

3. Services covered

Junubia may offer web hosting, domain registration, Google Workspace, NOR VPN, cloud or SaaS subscriptions, managed services, support services, and other ICT products or services. Not all services are available in all countries, and some are supplied through third-party vendors or registries.

4. Account registration

You must provide accurate, current, and complete information and keep it updated. You are responsible for all activity that occurs under your credentials and for maintaining the confidentiality of passwords, API keys, verification codes, and recovery methods.

5. Orders and activation

Orders are subject to acceptance, verification, screening, technical feasibility, stock or license availability, payment clearance, compliance checks, and any additional information reasonably requested by Junubia. Service activation times are estimates unless expressly guaranteed in a signed service commitment.

6. Pricing, taxes, and renewal

Prices, recurring fees, renewal charges, taxes, levies, and third-party pass-through fees are as shown on the applicable quote, order page, invoice, or statement of work. Unless clearly stated otherwise, recurring services renew automatically for the selected term and may be billed using the payment method on file.

7. Customer responsibilities

You are responsible for lawful use of the services, maintaining accurate registration and billing data, securing your own devices and applications, protecting your credentials, keeping backups where applicable, and ensuring that your content, instructions, and use of the services do not violate law or third-party rights.

8. Acceptable use

You may not use the services for unlawful content, intellectual-property infringement, phishing, malware distribution, abusive bulk messaging, network attacks, credential theft, circumvention of security controls, reselling without authorization, prohibited VPN use, or any activity that may damage Junubia, its vendors, other customers, or the public.

9. Domain names and registry rules

Domain registration and renewal services are subject to registry, registrar, and naming-authority rules, including required contact data and verification obligations. Junubia does not guarantee the availability of any requested domain. A domain may be suspended, transferred, corrected, or cancelled where required by applicable rules, dispute procedures, payment failure, or inaccurate registration data.

10. Hosting, cloud, and third-party service limitations

Service performance may depend on upstream providers, internet connectivity, vendor platforms, force majeure events, maintenance windows, software limitations, or customer-side configuration. Except to the extent expressly set out in a signed service-level commitment, Junubia does not guarantee uninterrupted or error-free service.

11. Apps and software

Use of our Android and iOS applications may also be subject to the terms of the relevant app store, device operating system, and integrated third-party software. You must install updates reasonably required for security, stability, or continued compatibility.

12. Support and communication

Support is provided through the channels, hours, and service levels published by Junubia or stated in the relevant contract. Junubia may contact you regarding support, billing, security, service incidents, account verification, or product changes using the contact details attached to your account.

13. Suspension and urgent action

Junubia may suspend, restrict, or disable access to any service immediately where reasonably necessary to address security incidents, abuse, non-payment, legal risk, sanctions or compliance screening, registry notices, court orders, fraudulent activity, or threats to infrastructure or third parties.

14. Termination

Either party may terminate a service in accordance with the applicable order term, cancellation process, or written agreement. Junubia may terminate for material breach, repeated policy violations, fraudulent or unlawful conduct, failure to maintain accurate registration data, or persistent payment default.

15. Customer content and intellectual property

You retain rights in your own lawful content. You grant Junubia only the limited rights reasonably necessary to host, transmit, process, back up, display, or otherwise handle that content in order to provide the services. Junubia retains all rights in its websites, apps, systems, branding, documentation, templates, processes, and service materials unless otherwise stated in writing.

16. Privacy and data handling

Junubia handles personal data in accordance with its Privacy Policy and any applicable data-processing arrangements. You remain responsible for obtaining any notices, consents, permissions, or lawful basis required for the data you cause Junubia to process through the services.

17. Refunds and cancellations

Refund rights, where any, are governed by the applicable Refund & Cancellation Policy, service description, quote, or written offer. Domain fees, third-party license fees, setup work, one-time implementation charges, consumed usage, and other pass-through or non-recoverable costs may be non-refundable even if a service is cancelled.

18. Disclaimers

To the maximum extent permitted by law, the services are provided on an "as is" and "as available" basis except where express warranties are set out in a signed agreement. Junubia disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement except to the extent such disclaimers are prohibited by law.

19. Limitation of liability

To the maximum extent permitted by law, Junubia shall not be liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, lost data, loss of goodwill, or business interruption. Junubia’s aggregate liability arising out of or connected with the service shall not exceed the amount actually paid by the customer to Junubia for the affected service during the [12]-month period preceding the event giving rise to the claim, unless a different cap is required by law or agreed in writing.

20. Indemnity

You agree to indemnify and hold harmless Junubia and its personnel, affiliates, and service partners from claims, losses, damages, fines, and costs arising from your unlawful use of the services, your breach of these Terms, your content, or your violation of third-party rights.

21. Changes to services or terms

Junubia may change features, vendors, technical specifications, pricing, or these Terms from time to time. Material changes may be communicated by website notice, email, invoice notice, in-app notice, or updated publication on the relevant service page.

22. Governing law and disputes

These Terms are governed by the laws of the United Republic of Tanzania unless another mandatory law applies. The parties shall first seek to resolve disputes in good faith through notice and discussion. If unresolved, disputes may be referred to the competent courts or another lawful dispute-resolution forum specified in the applicable contract.
